Former governor of Nigeria’s Central Bank, Prof Chukwuma Soludo , has dragged All Progressives Grand Alliance, APGA before an Abuja High Court challenging his disqualification from participating at the forthcoming gubernatorial election in Anambra state on the party’s platform.
Soludo recently decamped from the Peoples Democratic Party, PDP, to APGA, to enhance the realization of his aspiration to govern the state
The former top banker is seeking a judicial review of his 16th August ban by the APGA screening panel.
Five other aspirants were also barred along with him.
The panel had reportedly disqualified Soludo from participating in the party’s primaries slated for August 26th on the basis of an ongoing investigation by the Economic and Financial Crimes Commission, EFCC, for which he is considered a “potential high risk candidate”.
Dissatisfied with this development, Soludo approached the court on Thursday through a motion ex parte filed by his lawyer, Mr. Ikechukwu Ezechukwu, a senior advocate of Nigeria, praying the court to set aside the decision of the APGA screening panel for violating the party constitution and the 1999 constitution of Nigeria and to maintain the status quo ante bellum.
He also wants the court to grant an order of interim injunction restraining APGA from preventing him from participating in the primary of August 26, 2013 pending the determination of the motion on notice.
The presiding judge, Justice Peter Affen, however overruled Soludo’s lawyer on his oral submission that the matter can be entertained by the Abuja court on the ground that the party’s headquarters is situated in Abuja and ordered him to file further affidavits citing authorities of cases entertained outside the jurisdiction of the cause of action.
The senior advocate quickly complied with the court’s directive by filing further citations before the court but the court adjourned till Friday to rule on whether to entertain the matter or not.
Soludo also wants the court to make an order of Injunction restraining APGA by itself, its servants, privies, agents or otherwise howsoever from preventing, refusing and or denying him from participating in the Anambra State Gubernatorial Primary Election 2013.
